- PROMOTION DESCRIPTION: Sherwin-Williams Save Me! (the “Contest”) begins on August 23, 2018 at 12 p.m. and ends on September 2, 2018 at 11:59:59 p.m. (the “Contest Period”).
The sponsors of this Contest are Vintage Revivals LLC 3097 Santa Clara Dr. Santa Clara UT 84765 (“Vintage Revivals”) and Sherwin-Williams, (“Sherwin-Williams” and, together with Vintage Revivals, the “Sponsors”). Vintage Revivals is serving as the administrator of the Contest (“Administrator”). By participating in the Contest, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Administrator, which shall be final and binding in all respects. Administrator is responsible for the collection, submission or processing of Entries and the overall administration of the Contest. Entrants should look solely to Administrator with any questions, comments or problems related to the Contest. Administrator may be reached by email at [email protected] during the Contest Period.
- ELIGIBILITY: Open to legal residents reside within an approximate 400 mile radius of St. George UT who are at least eighteen (18) years of age and a head of their household (“Entrant”). The Sponsors, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the “Contest Entities”), are ineligible to enter the Contest or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
- PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): $15,000
Prize: One (1) winner will receive a complete room makeover in a room of their choice, provided by Sherwin-Williams and Vintage Revivals (ARV: $15,000).
The room makeover will occur durning September/October 2018 with dates to be specified, and the Winner shall make the room available to Vintage Revivals personnel for the duration of the Makeover Dates. In addition, the Winner will permit Vintage Revivals representatives periodic access to the premises in the days prior to the Makeover Dates in order to prepare for the room makeover. Entrants understand that the Prize is not an interior design consultation or collaboration with homeowner, but that Vintage Revivals will have sole decision making authority with respect to the design and product choices for the room makeover.
The Prize cannot be transferred, redeemed for cash or substituted by winner. Administrator reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if an element of the Prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the Prize represents Administrator’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsors make no representation or warranty concerning the appearance, safety or performance of any portion of the Prize awarded. Restrictions, conditions, and limitations may apply. Sponsors will not replace any lost or stolen Prize items.
All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the Prize winner. Failure to comply with the Official Rules will result in forfeiture of the Prize.
- HOW TO ENTER: During the Contest Period, an eligible Entrant may enter the Contest by posting a photo or video to their Instagram feed nominating themselves or an eligible friend (“Nominee”), with a caption or other description regarding why the Nominee deserves to win room makeover from Vintage Revivals, which post must tag Vintage Revivals (@vintagerevivals) and include the hashtag #SWSAVEME. All eligible Entrants must have a non-private Instagram account and be an active follower of Vintage Revivals (@vintagerevivals). PLEASE NOTE: If an Entrant submits a Nominee other than himself/herself, the Entrant must obtain permission from the Nominee prior to submitting the Nominee’s name or other information and photo.
An Entrant may create an Instagram account at no cost by visiting http://instagram.com. Creation of an Instagram account requires an Entrant to agree to Instagram’s Terms of Service and Privacy Policy, located at http://instagram.com/about/legal/terms/ and http://instagram.com/about/ legal/privacy/, respectively. Due to the way Instagram operates its services, entries from users with protected or private accounts (i.e., Entrant has set his or her account so that only people the Entrant has approved can view his or her updates) may not be received. This Contest is in no way sponsored, endorsed, or administered by, or associated with, Instagram.
By submitting an entry, an Entrant hereby grants permission for the entry, including the Entrant’s Instagram account name, if applicable, to be publicly posted on Sponsors’ social media accounts or websites, at Sponsors’ sole discretion. Once an entry is submitted, as described above, it may be made available on such social media accounts or websites for viewing by the general public and any such posting will be deemed made at the direction of the Entrant within the meaning of the Digital Millennium Copyright Act and the Communications Decency Act.
Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be posted by the end of the Contest Period in order to participate. Administrator’s database clock will be the official timekeeper for this Contest.
- WINNER SELECTION: At the end of the Contest Period, a group of Finalists will be chosen at random, from which one Winner will be selected through a comprehensive application screening process aimed at identifying the Finalist that could benefit the most from a Vintage Revivals room makeover. Factors to be considered in selecting the Winner may include: economic or family need, hardship or circumstances; home location and availability; and suitability for showcasing home décor product and design, among other factors. The screening process will conclude on or around September 9, 2018, and will be performed by representatives of Administrator, whose decisions are final and binding.
The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively, the “Prize Claim Documents”). Finalists may also be subject to an interview / background check before a Winner is determined and the Prize is awarded. Administrator reserves the right to disqualify a potential Winner based on the results of such interview / background check if Administrator determines in its sole discretion that awarding a Prize to any such individual might reflect negatively on the Sponsors. Upon verification of eligibility and compliance with these Official Rules, the winner will be contacted by Administrator to arrange Prize fulfillment. If a potential Winner is disqualified, found to be ineligible or not in compliance with these Official Rules, the Prize may be forfeited, and in the Administrator’s sole discretion, the forfeited Prize may be awarded to an alternate Winner, selected according to this Section 5, as determined by Administrator in its sole discretion.
THE WINNER WILL BE ISSUED A FORM 1099 FOR TAX PURPOSES, AS REQUIRED BY LAW, AND MUST SUBMIT HIS/HER SOCIAL SECURITY NUMBER OR TAXPAYER ID NUMBER FOR SUCH PURPOSE IN CONNECTION WITH COMPLETING THE WINNER DOCUMENTS. ALL FEDERAL, STATE AND LOCAL TAXES IMPOSED ON THE ACCEPTANCE OF A PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER.
- WINNER NOTIFICATION: Finalists will be notified by Instagram Direct Messaging by September 9, 2018. The final Winner will be notified on or before September 15, 2018. Any Winner or Finalist notification not responded to or returned as undeliverable may result in prize forfeiture.
The Winner will be contacted via Direct Message on Instagram and and may also be announced on Vintage Revivals Instagram and other social media platforms, including, but not limited to, Facebook, Twitter and Pinterest and on vintagerevivals.com.
- LIMITATION OF LIABILITY: Sponsors assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to Entrant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Contest.
By entering, each Entrant or Nominee agrees to release and hold harmless the Sponsors, Instagram, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind (including, without limitation, attorneys’ fees) arising out of, resulting from, or by reason of, any application for or participation on or in connection with the Contest, or the receipt or use of any portion of the Prize, including, without limitation, participation in the selection process of the Contest, any exploitation of the Contest or any appearance in conjunction with the Contest, the failure of the Sponsors to select Nominee as a Finalist or Winner, the cancellation of the Contest, any use of Entrant’s or Nominee’s likeness or Contest entry, the entry onto or into a Finalist’s or Winner’s residential property or home by Vintage Revivals and its agents, or the use, alteration or modification by Vintage Revivals of Winner’s residential property and home and contents thereof, in connection with the Contest, or the exercise by the Sponsors of any rights granted hereunder, on any legal theory whatsoever (including, but not limited to, personal injury, property damage, rights of privacy and publicity, false light, or defamation) (collectively the “Released Claims”). The Released Claims specifically include, without limitation, any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind resulting from the actions of another participant or any other third party at any time.
Entrants and Nominees understand that the above release is a material inducement for the Sponsors to proceed with the Contest, and that the Sponsors and the other Released Parties may rely on this release in proceeding with the Contest.
- CONTEST ADMINISTRATION: If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Administrator reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part. In such event, Administrator reserves the right to award the Prize (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Administrator. The Sponsors and Released Parties shall not have any further liability to any participant in connection with the Contest.
